1. Acceptance of Terms
By accessing or using PulseForge, you agree to these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
PulseForge provides uptime monitoring, server keep-alive, and related services. We reserve the right to modify, suspend, or discontinue any part of the service at any time.
3. Account Registration
You must provide accurate and complete information when creating an account.
You are responsible for safeguarding your account credentials.
You must notify us immediately of any unauthorized access to your account.
We reserve the right to terminate accounts that violate these terms.
4. Acceptable Use
You agree not to use the service to:
- Monitor endpoints without proper authorization
- Conduct DDoS attacks or other malicious activities
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Send spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
5. Payment and Billing
Some features require payment. You agree to pay all fees associated with your selected plan.
All payments are non-refundable unless otherwise specified.
We may change pricing with 30 days notice.
Failure to pay may result in service suspension.
6. Service Level Agreement
We strive for 99.9% uptime for our service. However, we do not guarantee uninterrupted access. Scheduled maintenance and unforeseen circumstances may result in temporary service interruptions.
7. Limitation of Liability
PulseForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. Our total liability shall not exceed the amount you paid us in the past 12 months.
8. Indemnification
You agree to indemnify and hold harmless PulseForge and its employees from any claims, damages, or expenses arising from your use of the service or violation of these terms.
9. Termination
You may terminate your account at any time. We may suspend or terminate your access for violations of these terms. Upon termination, your data will be retained according to our Privacy Policy.
10. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance.
11. Governing Law
These terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County.
